The South Dakota House has proposed a bill that would amend the South Dakota criminal code to make abortion a form of child abuse. If it becomes law, doctors who provide abortion – and the women they serve – could be guilty of a class 3 felony.  With just 15 words, abortion could be banned in the state of South Dakota. 

These 15 words could:

  • Criminalize all abortions for any reason
  • Make a woman and her doctor guilty of a class 3 felony for having an abortion for any reason - even if her pregnancy endangers her health or life
  • Make it a class 3 felony to expose a pregnancy, beginning from the moment of conception, to any form of risk
  • Cause women to be investigated for miscarrying a pregnancy 
  • Impact and possibly prohibit the practice of In Vitro-Fertilization

Abortion is a deeply personal and often complex issue. Ultimately, decisions about whether to choose adoption, end a pregnancy, or raise a child must be left to a woman, her family and her faith, with the counsel of her health care provider, not politicians.

Don't Criminalize Women

Dear South Dakota Legislature, 

I am deeply troubled by House Bill 1212 which would amend the current state statute on child abuse to include calling on the Supreme Court of the United States to overturn Roe v. Wade.

This bill could criminalize all abortions for any reason. Under this bill, a woman who has an abortion, for any reason - even if her pregnancy endangers her health or life - guilty of a class 3 felony.

In addition, a pregnant woman who does anything that a prosecutor considers "risky" could be tried for child abuse and sentenced to up to 15 years in prison. Women could be investigated for miscarriages an any form of birth defect, even if these is no evidence that they did anything wrong to harm the pregnancy.

Abortion is a deeply personal and often complex issue. Ultimately, decisions about whether to choose adoption, end a pregnancy, or raise a child must be left to a woman, her family and her faith, with the counsel of her health care provider.

Please remember this as House Bill 1212 moves to a vote.
